The objective of this study is to achieve several objectives, the most important of which are to demonstrate the legal and legal basis for protecting the rights of persons with disabilities in the Saudi system, by publicizing them, knowing their rights and advantages, as well as highlighting the interest of Islamic law and the Saudi regime in persons with disabilities, as well as knowledge of regulations and instructions relating to them.
In order to achieve the objectives of the research, the researcher used the descriptive curriculum in the exhibition of the rights of persons with disabilities in the Islamic sharia, the Saudi regime and the international system. The comparative curriculum was also used between the Saudi regime and the School of Islamic Jurisprudence. The scope of the study has been limited to Islamic sharia law, legal regulations applicable in the Kingdom and some international instruments relating to the rights of persons with disabilities.
The study found several conclusions, the most important of which being that excuse or disability in Islamic law is a case or an accidental description of the cost. and calls for the commutation, omission or replacement of the lawful sentence without wrongfulness, The Kingdom's law has taken into account the development of an integrated system for the care of the rights of persons with disabilities in all health, cultural, political and all other fields. and Islam has initiated alternative legitimate provisions in the event of a person's inability to perform the original provisions such as timing in the event that it is not possible to wash or light. Islam has also initiated special legal provisions known as "legitimate permits".
In the light of the results of the study, several recommendations were made, the most important of which being the need to establish mechanisms for persons with disabilities to have access to technological rehabilitation for education and training, and to select competencies from them to work in the fields of scientific and technical research to provide specialized studies and research on the challenge of such disabilities, whatever they may be. While it was important to raise society's awareness of the rights of persons with disabilities, which preserved their humanity and dignity, he urged the relevant government agencies to involve individuals with disabilities in international conferences and committees that sponsored their rights. |
