Jurisprudential inference stands on three pillars: the inferrer, the proof, and the proof exploitation method, which is the topic of linguistic signifiers within “Usul Al-fiqh”, among the signifiers, contextual indicators are considered the most important, as they rule the others, by restricting general injunctions, qualifying the unqualified, clarifying the intricate, and deflecting the apparent and probable, to the extent that parts of a phrase bearing the same contextual meaning are omitted.
Ibn jarir altabri is known for his reliance on contextual indicators, and this is evident in his proficient interpretation of the verses of the book, where he accumulated precious sayings and enlightened minds with his eloquence, which is why his book “Jāmiʿ al-bayān ʿan taʾwīl āy al-Qurʾān“ was chosen to be the subject of this study, as he relied on contextual indicators for jurisprudential inference in “Surat Al-Baqarah” in 22 cases.
This research is divided into a theoretical and an applied study, the theoretical study lays the foundations for contextual indicators, by clarifying their definition, types, significance and impact on inference.
The theoretical study briefly covers Altabri, his birth and childhood, his final days and work, along with some of the attributes that indicate why his interpretation is a rich ground for applied studies. The study then covers “Jāmiʿ al-bayān“, its scientific merit, a brief description of Altabri’s interpretation methodology, and other work that has been based on his.
The applied study extends over 22 chapters, to include the jurisprudential cases within “Surat Al-baqarah” where “Altabri” infers through contextual indicators.
The theoretical study illustrates the rule of contextual indicators over other linguistic signifiers, while the applied study illustrates the centricity of inference through contextual indicators among jurists. |
