Abstract : The first objective: To highlight the extent of the jurisprudence's relationship to the reality of people and its inclusion in the needs of society through this research The second goal: to demonstrate a juristic balance in dealing with people of different degrees and positions. The third goal: To highlight the considerations and consequences that were mentioned in Islamic jurisprudence which he placed on those with positions. Fourth goal: Trying to reach a doctrinal theory about the position by studying these issues. Fifth Objective: Attempting to assimilate the various issues of the topic and collect its diaspora in an integrated research. Sixth Objective: An attempt to make recommendations at the end of the research that helps increase interest in this topic This study reveals the nature of the relationship of jurisprudence with the reality of people as individuals for any society who disagree in their homes and positions, and how Islamic jurisprudence took into account this disparity in the balance of justice and known. And the student about the extent of jurisprudence attention to this matter. In this study, the researcher relied on the descriptive, analytical, critical and comparative approach, based on tracing jurisprudential issues related to the subject of the thesis, describing it accurately, and then analyzing it in order to reach results of a total nature. The researcher has adhered to a set of academic rules organizing research and scientific theses, such as caring for the statement of the fence numbers and the issuance of hadiths and monuments with indicating the degree of hadith and impact, the study of jurisprudential issues, translation of flags, and caring for words and terms with their statement
