Abstract : The stage of Public Prosecution is considered as one of the important stages in instituting the public penal procedure. The Prosecutor is closely tied to the public penal procedure requiring the clarification of the limitations of the Prosecutor's power to file the public claim. Its purpose is to identify the regulations of the Public Prosecution and the competent authority in the Kingdom of Saudi Arabia and highlight the restrictions on the authority of the Public Prosecution to institute the public claim in addition to recognizing agencies filling the public claim other than the Public Prosecution and stating the grounds for the abatement of penal proceedings. The study was based on the descriptive and analytical inductive concept referring to the provisions of the Islamic Shari'a law and the Saudi penal procedure. The study was divided into three chapters.
