Abstract : The study deals with the criminal liability of the pharmacist in respect of the illegal sale of medicine under Saudi laws – Comparative Study. The significance of this study is manifested by the serious damage arising out of the crimes of the illegal sale of medicine, so that the least amount of fraud, mistake or negligence that takes place upon the sale thereof may lead to results leading to dire consequences. This study aims at defining the profession of pharmacology and of pharmacist, as well as determining the facets of pharmacological business, and to acquaint one with the conditions to practice the profession of pharmacology and the obligations of a pharmacist, as well. Furthermore, it also aims at examining the aspects of the crime of the illegal sale of medicine, whether willful or not, which pertain to commercial fraud or relate to statutory licenses and the penalties arising out of such violations. In the light of the hypothesis presented for the subject of the study, and the goals and nature of the study, help was sought in the comparative, descriptive and analytical methodology and was also sought in the descriptive approach which relies on reviewing the objective rules incriminating the illegal sale of medicine and the penalties prescribed for the sale thereof. In addition, assistance was sought in the analytical approach which helps to find out what lies behind the texts as well as arrive at the results and the jurisprudence (Islamic Fiqh) views that have been put forward in this respect. Assistance was further sought in the comparative approach by conducting a comparative study with the Egyptian law with the aim of benefiting from Arab legislations in unveiling the mystery from some of the texts that are the subject-matter of the study, and what they should be like in order to assimilate and understand the illegal sale of medicine. In an attempt to answer the questions raised by the study and to achieve its basic goals, and in conformity with the scientific methodology followed, we have divided the study into a preliminary research in which we dealt with the legal organization of the profession of pharmacology, and three chapters: where in the first chapter we dealt with the crimes for the illegal sale of medicine relating to commercial fraud, and in the second chapter we dealt with crimes for the illegal sale of medicine relating to medical prescriptions, and in the third chapter we dealt with the crimes for the illegal sale of medicine pertaining to legal licenses. The study arrived at a number of conclusions and recommendations, the most prominent of which is the necessity to strive to arrive to an independent and special law for organizing the profession of pharmacology and sale of medicine in order to be consistent with the mammoth scientific development made in the field of the profession of pharmacology and medicine.
